MEMBERSHIP REFUND POLICY

Membership fees are non-refundable. ESCV reserves the right to review individual cancellation/refund requests for specific cases.

Requests received after 10 days of joining ESCV membership will not be eligible for a refund.

Refund requests must be made in writing by the payer and will be accepted by e-mail. Requests must be received by the stated cancellation deadline.

In the case of credit card payment:

Refund requests must include the following information:

• membership number,
• full name of the member,
• full name of the card holder of the card used to make the payment
• last 4 digits of the credit card used to make the payment

Refunds will be credited back to the original credit card used for payment.

In case of wire transfer payment:

Refund requests must include the following information:

• membership number
• name of the member
• name of the payer

Bank transfer charges will be deducted from the refunded amount.

After cancellation, the member will no longer receive any related ESCV membership benefits.

LIMITATIONS OF LIABILITIES

You expressly understand and agree that your use of the services is at your sole risk and that the services are provided “as is” and “as available.” in particular, ESCV, its subsidiaries and affiliates, and its licensors do not represent or warrant to you that: (a) your use of the services will meet your requirements, (b) your use of the services will be uninterrupted, timely, secure or free from error, (c) any information obtained by you as a result of your use of the services will be accurate or reliable, and (d) that defects in the operation or functionality of any software provided to you as part of the services will be corrected.

ESCV  further expressly disclaims all warranties and conditions of any kind, whether express or implied, including, but not limited to the implied warranties and conditions of merchantability, fitness for a particular purpose and non-infringement.

You expressly understand and agree that ESCV, its subsidiaries and affiliates, and its licensors shall not be liable to you for: (a) any direct, indirect, incidental, special consequential or exemplary damages which may be incurred by you, however, caused and under any theory of liability. this shall include, but not be limited to, any loss of profit (whether incurred directly or indirectly), any loss of goodwill or business reputation, any loss of data suffered, cost of procurement of substitute goods or services, or other intangible loss; (b) any loss or damage which may be incurred by you, including but not limited to loss or damage as a result of: (i) any reliance placed by you on the completeness, accuracy or existence of any advertising, or as a result of any relationship or transaction between you and any advertiser or sponsor whose advertising appears on the services; (ii) any changes which ESCV may make to the services, or for any permanent or temporary cessation in the provision of the services (or any features within the services); (iii) the deletion of, corruption of, or failure to store, any content and other communications data maintained or transmitted by or through your use of the services; (iv) your failure to provide ESCV with accurate account information; (v) your failure to keep your password or account details secure and confidential;

The limitations on ESCV liability to you above shall apply whether or not ESCV has been advised of or should have been aware of the possibility of any such losses arising.

Some jurisdictions do not allow the exclusion of certain warranties or conditions or the limitation or exclusion of liability for loss or damage caused by negligence, breach of contract or breach of implied terms, or incidental or consequential damages. accordingly, only the limitations which are lawful in your jurisdiction will apply to you and our liability will be limited to the maximum extent permitted by law.

You agree to defend, indemnify, and hold us, our related companies, affiliates, subsidiaries, joint ventures, third-party service providers, and our respective employees, contractors, agents, officers, and directors harmless from all claims, liability, damages, losses, costs and expenses, including legal fees, that arise out of or are related to any breach of the terms by you or any other liabilities incurred by us arising out of your attendance or participation or access to the online event

GOVERNING LAW

These Terms of Use are governed by and interpreted in accordance with the laws of Switzerland, excluding that body of law related to the choice of laws. Any proceeding brought to enforce these Terms of Use to adjudicate any dispute related to these Terms of Use must be heard in the courts of Geneva, Switzerland. Each party submits itself to the exclusive jurisdiction and venue of these courts for purposes of proceedings related to these Terms of Use, waives forum non-convenience and similar defences, and agrees that any service of process may be affected by the delivery of the summons to the address for notice as specified herein.
